A MAN who left a former partner “shaking with fear” when he breached a restraining order by loitering outside her home and shouting abuse has been sent back to jail.

Bradford Crown Court heard that Stephen Drake breached the indefinite restraining order from 2019 just days after being released from prison for an earlier breach of the same order.

Prosecutor Ben Whittingham said 42-year-old Drake parked outside the woman’s home, shouted verbal abuse but fled after 45 minutes when the police were called. The victim was left “shaking with fear”.

He was arrested on April 20 last year and denied being present.

Two months later Drake was caught on CCTV pawning a bracelet and a ring in a Bradford city centre pawn shop for £980.

The jewellery had been stolen during a burglary in the early hours of June 15. The victim made inquiries at pawnbrokers in Bradford and was told two males had worked together to try and pawn a bracelet and a ring.

They matched items that had been stolen from her address. She later found they had been pawned and they were recovered from the pawn shop.

At about 3am on August 14, Drake attempted to use a stolen bank card at two shops but was unsuccessful. The card had been taken in a burglary earlier that morning. He later denied any fraud by false representation.

Drake, formerly of Flower Bank, Bradford, was identified from CCTV footage and arrested on September 21. He admitted pawning the items but denied any knowledge that they were stolen.

Instead, he said he acted on the request of a friend and received £80.

The court heard that Drake had a lengthy list of prior convictions including for offences of dishonesty and burglary.

Mitigating for Drake, Umar Shahzad said being in custody had been “a wake-up call” for him and that he had tried to turn his life around by avoiding substance misuse.

Sentencing Drake, Mr Recorder Bryan Cox KC said he had a poor record for not complying with court orders and that the breach of the restraining order was particularly aggravating as it occurred days after he was released from custody.

He said: “You have demonstrated a determination to disregard such orders.”

For breaching the restraining order, failing to surrender to police, and handling stolen goods he sentenced Drake to a total of two years in prison.
